Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you and the operator of NursingCEA (“NursingCEA,” “we,” “us,” or “our”) and govern your access to and use of the NursingCEA website at nursingcea.com and all related content, features, tools, and services (collectively, the “Service”). Please read them carefully. By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy and Disclaimers, which are incorporated by reference. If you do not agree, do not access or use the Service. Sections that limit our liability, disclaim warranties, and govern dispute resolution are especially important — read them in full.

“NursingCEA” is a brand name, not a description of what we provide. The Service is a free practice-and-study resource only. We are not a continuing-education provider; we grant no CE credit, contact hours, certificates, or professional certification, and we are not accredited by any board or credentialing body (see Section 4). The Privacy Policy and Disclaimers referenced above, each shown with its own “last updated” date, form part of the agreement between you and us.

1. Acceptance of these Terms

By creating an account, entering your email, taking a practice test, or otherwise using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” refers to that organization.

Electronic acceptance and communications. You confirm that you can access and review these Terms electronically, and you agree that clicking to agree, creating an account, or completing a passwordless sign-in is your affirmative acceptance of them. You consent to receive these Terms, the Privacy Policy, the Disclaimers, and all notices and other communications from us electronically (by email or in-product notice), and you agree that electronic acceptances, click-throughs, and emailed sign-in links satisfy any requirement that an agreement or notice be in writing under the federal E-SIGN Act, the Uniform Electronic Transactions Act (UETA), and any similar law. You may withdraw this consent by stopping use of the Service and closing your account; withdrawal does not affect anything already done before it.

2. Eligibility

The Service is intended for adults who are pursuing or already hold a nursing or allied-health credential. You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to create an account or otherwise use the Service. The Service is not directed to minors, we do not knowingly collect personal information from anyone under 18, and if we learn we have, we will delete it (see our Privacy Policy). If you are under 18, do not use the Service. You also represent that you are not barred from using the Service under the laws of any applicable jurisdiction.

3. What NursingCEA is

NursingCEA provides free, original practice questions, quizzes, study guides, calculators, and study tools for nurses, nursing students, and allied healthcare candidates. Our practice material spans several exams and roles — including the NCLEX-RN® and NCLEX-PN®, the CNA / nurse-aide competency exam, the Patient Care Technician (CPCT/A) credential, and the Phlebotomy Technician (CPT) credential. Across every field, the Service is an educational practice and study resource only. Our items are original and are not real exam questions.

4. Not a continuing-education provider — no credit, certification, or registry

NursingCEA is not a continuing-education provider. We do not grant continuing-education (CE) credit, contact hours, certificates, or professional certification for anything on the Service; we are not accredited by any board, agency, or credentialing body; we issue no certificates; and we do not place anyone on any state Nurse Aide Registry or other registry. Nothing on the Service satisfies any state Board of Nursing’s, employer’s, or credentialing body’s licensure, certification, or renewal requirements. Any licensing, certification, or continuing-education information we publish is general, informational content only — always confirm current requirements with your state Board of Nursing or the relevant credentialing body.

5. Educational use only — not medical, professional, or legal advice

All questions, rationales, study guides, and tools are for study and practice only. They are not medical, clinical, professional, or legal advice, and are not a substitute for clinical judgment, your facility’s policies, your instructor’s guidance, or current provider orders. No professional-client, provider-patient, or advisory relationship is formed by your use of the Service. Content is written and reviewed for accuracy, but reference ranges, drug information, and guidelines vary by source and change over time — always verify against current, authoritative clinical references before applying anything in practice. Our calculators are practice aids; verify every calculation before administering any medication. Never make a patient-care decision based on the Service.

6. No outcome or exam-pass guarantee

We do not guarantee that using the Service will cause you to pass the NCLEX, any certification or licensure exam, any course, or any assessment, or that it will improve any score or result. Practice and study are not a guarantee of any outcome, and individual results vary. Any score or percentage the Service shows you is a study aid to gauge your practice performance — it is not a prediction of how you will do on a real exam. Exam results depend on many factors outside our control, including your own preparation, the exam’s content and scoring, and the policies of the testing and credentialing bodies. You assume all risk associated with relying on the Service for exam preparation. Any statistics, percentages, scores, examples, success stories, or testimonials that may appear on the Service are illustrative only — they reflect hypothetical scenarios or the individual experience of a particular person, are not typical, and are not a promise or prediction of your result. If we ever feature a testimonial, we will clearly disclose any material connection between us and the person giving it.

7. Your account

You can use much of the Service without an account. A free account (created passwordlessly via an emailed link or code) saves your scores and progress. You are responsible for maintaining the confidentiality and security of the email account you use to sign in and for all activity that occurs under your account. Provide accurate information, keep it current, and do not use another person’s email or impersonate anyone. Notify us promptly of any unauthorized use. We are not liable for any loss arising from unauthorized use of your account.

8. Limited license to use the Service

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Service and its content for your own personal, non-commercial study and educational use. This license does not include any right to resell, redistribute, or create derivative works from the Service or its content, or to use it for any commercial purpose, except with our prior written permission. Any account is for a single individual and may not be shared. We reserve all rights not expressly granted, and we may suspend or terminate your access for any violation of these Terms.

8A. The Service is free today; future fees

The Service is currently offered free of charge, and no purchase is required. We reserve the right to introduce fees, paid tiers, or paid features in the future. If we do, we will describe the price and terms before you are charged, any paid feature will be optional and require your affirmative agreement, and you may continue to use whatever remains free or close your account rather than pay. We will never charge you for a paid feature without your consent.

8B. Beta and experimental features

We may offer features labeled “beta,” “experimental,” “preview,” or the like, including the AI tutor. These features are provided as-is, may contain errors, and may be changed, limited, or discontinued at any time without notice. You should not rely on them for any important or time-sensitive purpose, and the warranty disclaimer and limitation of liability in Sections 15 and 16 apply to them fully.

9. Intellectual property

The Service and all of its content — including every practice question, answer choice, rationale, study guide, article, tool, calculator, text, graphic, logo, layout, design, and the compilation and arrangement of all of it — are the original, proprietary work of NursingCEA (or our licensors) and are protected by copyright, trademark, and other intellectual-property laws. Every practice question is original work authored by our team. Except for the limited license in Section 8, you may not copy, reproduce, republish, distribute, display, perform, sell, license, modify, create derivative works from, scrape, data-mine, or otherwise exploit any part of the Service or its content without our prior written consent. All NursingCEA names, logos, and marks are our property; other marks are the property of their respective owners (see Section 14).

9A. Feedback and suggestions

If you send us ideas, suggestions, corrections, proposed questions, comments, or other feedback about the Service (“Feedback”), you grant us a worldwide, perpetual, irrevocable, royalty-free, fully paid-up, transferable, and sublicensable license to use, reproduce, modify, adapt, and otherwise exploit that Feedback for any purpose — including to operate, improve, and build on the Service — with no obligation to use, credit, or compensate you. You represent that you own or otherwise have the right to share any Feedback you submit, and that it is not confidential to you or anyone else. Please do not send us anything you consider confidential or that you are not free to share.

10. Copyright complaints (DMCA)

We respect intellectual-property rights and expect users to do the same. If you believe content on the Service infringes your copyright, send a notice to our designated agent that includes: your contact information; identification of the copyrighted work; identification of the allegedly infringing material and its location on the Service; a statement that you have a good-faith belief the use is not authorized; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act; and your signature. Send notices via our contact page or to our copyright agent at legal@nursingcea.com. We may remove or disable allegedly infringing material, and we terminate the accounts of repeat infringers. If you believe material you submitted was removed or disabled by mistake or misidentification, you may send us a counter-notification under 17 U.S.C. § 512(g) that includes: your physical or electronic signature; identification of the material and where it appeared before removal; a statement, under penalty of perjury, that you have a good-faith belief the material was removed by mistake or misidentification; your name, address, and telephone number; and a statement that you consent to the jurisdiction of the federal court for your address (or, if outside the U.S., any district in which we may be found) and will accept service of process from the party who filed the original notice. We may forward your counter-notification to that party and may restore the material as the DMCA permits.

The optional “Ask the tutor” feature generates explanations using a third-party AI model provider. AI answers may be incomplete or inaccurate, are not authoritative, are not medical or professional advice, and are not a substitute for your instructor or your own clinical judgment — verify anything important before relying on it. The feature is rate-limited and provided on an as-available basis; we may change, limit, or discontinue it at any time. When you use it, only your typed question and the practice-question content already on your screen are sent to the provider — never your name, email, or account credentials. Those AI providers operate under their own terms and privacy policies, which we do not control, and we cannot guarantee that they will not log or retain what is sent to them on their own systems. Do not submit personal, patient, confidential, or protected health information to the tutor. See our AI-content disclaimer.

13. Third-party services and links

The Service relies on third-party providers for hosting, email delivery, spam protection, and the optional AI tutor, and may contain links to third-party websites and resources, such as state Boards of Nursing and credentialing bodies. We do not control and are not responsible for third-party services, their availability, or their content, and a link is not an endorsement. Your use of any third-party service or site is governed by that third party’s own terms and privacy policies, and is at your own risk.

NCLEX®, NCLEX-RN®, and NCLEX-PN® are registered trademarks of the National Council of State Boards of Nursing, Inc. (NCSBN). NNAAP® is a program of Credentia; CPCT/A® and CPT credentials and the NHA name are marks of the National Healthcareer Association; other credentials are marks of bodies such as ASCP and AMT. All such names are used nominatively, only to describe the exams and roles our material helps you prepare for. NursingCEA is not affiliated with, endorsed by, sponsored by, or certified through any of them. See our full disclaimers.

15. Disclaimer of warranties — “as is” / “as available”

THE SERVICE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. To the fullest extent permitted by law, we disclaim all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free; that any content is accurate, complete, reliable, or current; that defects will be corrected; or that the Service or its servers are free of harmful components. We do not guarantee any uptime or availability. Any material obtained through the Service is used at your own discretion and risk.

16. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NursingCEA and its operators, owners, officers, employees, contractors, and suppliers WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OPPORTUNITY, arising out of or relating to your use of (or inability to use) the Service, including any clinical, academic, examination, or licensure decision made in reliance on it, even if we have been advised of the possibility of such damages, and regardless of the theory of liability.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED US $100 or the total amount you have paid us in the twelve (12) months before the claim (which is US $0 for free access), whichever is greater. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you; in that case our liability is limited to the maximum extent permitted by law.

The disclaimers and limitations in Sections 15 and 16 are for the benefit of NursingCEA and its operators, owners, officers, employees, contractors, suppliers, and service providers, each of whom may rely on and enforce them as a third-party beneficiary.

17. Indemnification

You agree to indemnify, defend, and hold harmless NursingCEA and its operators, owners, officers, employees, contractors, and suppliers from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your violation of these Terms, your violation of any law or third-party right, or any content you submit.

18. Assumption of risk

You understand that the Service is an educational study aid, that clinical and medical information carries inherent risk, and that you are solely responsible for how you use the Service and any decisions you make. You knowingly and voluntarily assume all risks associated with your use of the Service and its content.

19. Suspension & termination

We may suspend, restrict, or terminate your access to the Service at any time, with or without notice, including for any violation of these Terms or conduct we deem harmful to the Service or other users. You may stop using the Service and request deletion of your account at any time (see the Privacy Policy). We may also treat an account as inactive and delete or de-identify it after a prolonged period without any sign-in. The provisions that by their nature should survive termination — including intellectual property, the feedback license, disclaimers, limitation of liability, indemnification, the sanctions and export-control terms, and dispute resolution — will survive.

20. Changes to the Terms and the Service

We may update these Terms from time to time; the “last updated” date reflects the current version. For changes that materially affect your rights, we will take reasonable steps to notify you before they take effect — for example, by email to the address on your account or by a notice on the Service. Minor changes (such as clarifications or contact updates) are shown only by an updated date. Continued use of the Service after changes take effect means you accept the updated Terms; if you do not agree, stop using the Service and close your account. We may also modify, suspend, or discontinue any part of the Service at any time.

21. Governing law & dispute resolution

These Terms are governed by applicable United States federal law and the law of the jurisdiction in which NursingCEA operates, without regard to conflict-of-laws rules. You and we agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts with jurisdiction over that location, and you consent to their personal jurisdiction. The Service is operated under the name NursingCEA.

Informal resolution first. Before filing any claim, you agree to try to resolve the dispute informally by contacting us through our contact page and giving us at least 30 days to respond. Many concerns can be resolved this way.

22. Severability, waiver, assignment, entire agreement

If any provision of these Terms is held unenforceable, that provision will be limited or severed to the minimum extent necessary and the rest will remain in full force. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them freely (for example, in connection with a merger or sale). These Terms, together with the Privacy Policy and Disclaimers, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements. Section headings are for convenience only and do not affect the meaning of these Terms.

22A. Sanctions & export controls

You represent that you are not located in, ordinarily resident in, or a national of any country or region subject to comprehensive U.S. sanctions, and that you are not on any U.S. government list of restricted or prohibited parties (including the U.S. Treasury’s Specially Designated Nationals list). You agree not to use the Service where doing so would violate any applicable export-control or sanctions law, and we may suspend or terminate access as needed to comply with those laws.

23. Force majeure

We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including acts of God, natural disasters, outages of any hosting, email-delivery, AI-model, or other third-party provider we rely on, network or power failures, labor disputes, or governmental action.
